Понятие и виды процессуального соучастия в международном коммерческом арбитраже

Abstract

Рассматриваются общественные отношения в области процессуального соучастия в международном коммерческом арбитраже. На основе анализа действующего правового регулирования процессуального соучастия в международном коммерческом арбитраже определены основные тенденции и проблемы данного регулирования, показаны возможные подходы совершенствования в законодательстве, сформулированы определения понятий «многосторонний арбитраж» и «третьи лица в международном коммерческом арбитраже», выявлены основные виды процессуального соучастия в международном коммерческом арбитраже. = The subject of the article are social relations that develop in the sphere of multi-party and multicontract situations in international commercial arbitration. The authors tried to analyse the current legal regulation of multiparty and multicontract arbitration in international commercial arbitration in order to identify the current tendencies and problems of the legal regulation, and to formulate possible approaches for improvement of the Belarusian legislation. As a result of the research the author’s definitions of the terms «multiparty arbitration» and «third parties in international commercial arbitration» were formulated, the main forms of multiparty arbitration were revealed.
